Introduction
To make a successful clinical negligence claim you have to prove a causal link between a breach of duty and the injury suffered. Proving causation is key however it is difficult to establish.
The claimant must show that if he or she has received the right treatment he or she would not have suffered the injury. The court is required to speculate on what would happen on the balance of probabilities. Our eminent speakers will examine causation post-Bailey and offer you an update on the latest case law.
