Introduction
A Design Right is the legal protection available to unregistered designs in the UK. Unlike Registered Designs, a Design Right gives you automatic protection for the internal or external shape or configuration of an original design, i.e. its three-dimensional shape. It is used to prevent someone from copying the shape or configuration of the article, but does not give protection for any of the 2-dimensional aspects. The protection is limited to the UK only. This webinar will consider the types of design rights available and review the latest caselaw including the long-awaited judgment on PepsiCo Inc v Grupo Promer by the Court of Justice of the European Union.
