Lord Justice Jackson is proposing to introduce a ‘menu’ of disclosure options. Taking into account the burden and cost of standard disclosure, there will no longer be a presumption in its favour. Instead the court will have to decide which order to make with ‘regard to the overriding objective and the need to limit disclosure to that which is necessary to deal with the case justly’. These proposals will apply to all multi-track cases, apart from personal injury and clinical negligence. It is expected that they will be implemented with the rest of Jackson’s far reaching reforms in April 2013.
