Evidence - Bad Character, Hearsay And Witness Statements

Introduction

In the case of Al-Khawaja and Tahery v the UK the European Court of Human Rights confirmed that the use of hearsay evidence, where no other evidence is available, does not breach Article 6.

Imad Al-Khawaja, a physician at Brighton General Hospital, was convicted of indecent assault on two female patients. The decisive evidence was delivered in a written statement by one of the victims, who committed suicide before the trial began.
