Introduction
Section 20, Landlord and Tenant Act 1985, requires landlords to consult their tenants before incurring certain items of service charge expenditure. The consultation requirements are contained in the Landlord and Tenant Act 1985 and Service Charges (Consultation Requirements) (England) Regulations 2003 (SI 2003/1987).
A leasehold valuation tribunal may dispense with any or all of the consultation requirements where it considers this reasonable. In considering whether to grant dispensation, an LVT should consider whether the breach of the consultation regulations has caused significant prejudice to the leaseholders.
