Financial and judicial pressures on PCTs are making the life of commissioners increasingly difficult. This workshop will focus on three areas where the pressures have been and are likely to remain acute for commissioning PCTs:-

  • The impact of the HS Constitution and the extent of NHS duties to provide care, both generally and in particular whether that care must be provided at home.
  • How far duties of non discrimination affect the ability of the PCT to commission effectively for the many rather than individuals, and
  • The impact of recent decisions on the perennial topic of HS continuing healthcare, and in particular issues in connection with how claimants can bring claims post Jones v Powys LHB and the validity of the ‘cut off date ‘ for claims for retrospective review.

Finally, the workshop will provide an update on mental health judicial reviews.
