Social Housing: Governance, Regulation & Funding
The social housing sector is undergoing major changes. The Housing & Regeneration Act 2008 has resulted in a new framework for the regulation and funding of social housing. From 1st April 2010, social housing providers registered with the Tenant Services Authority (TSA) will need to comply with new output-based standards in a co-regulatory environment and will be subject to the TSA’s range of enforcement powers, some of which are new.
The Act also brought together the funding capabilities of the Housing Corporation and the land holdings and regeneration capabilities of English Partnerships within the Homes and Communities Agency (HCA). In the ongoing uncertain economic climate, it is essential that social housing providers are aware of the HCA’s latest thinking on funding and investment.
Other major changes affecting the social housing sector include the ramifications of the Weaver case. This establishes that decisions of social housing providers are susceptible to challenges on human rights grounds and judicial review proceedings.
