The October 2008 implementation is the penultimate tranche of legislation to come into force before the remainder of the Act is implemented in October 2009. Containing several provisions that deal with directors' conflicts of interest and their disclosure, it is likely that some difficult times may lie ahead for directors who are unable to disclose the circumstance of one particular conflict owing to a duty of confidentiality to another company.
