An intensive two day course on preparing, prosecuting and enforcing patents in the U.S.

Introduction

This two-day course will address the current law on US patents as well as these daunting and interesting changes and give you essential guidance and strategies for addressing everything from the creation and procurement of patent rights through to their exploitation and enforcement in the U.S. The course tutors will identify and examine key differences between the U.S. common law system and the rest of the world and provide hands-on techniques and strategies and cover all major aspects of the U.S. patent system with a particular focus on the day-to-day differences encountered by a European Practitioner.

Designed to meet the needs of European practitioners who wish to increase their knowledge of the evolving U.S. patent system; course highlights include:

  • Surveying the sweeping changes expected for the U.S. patent system, including first-to-file rules, a post-grant review procedure (opposition), inter partes review and supplemental examination
  • Drafting the global patent application
  • Reading the Federal Circuit "tea leaves" on claim construction and inequitable conduct and drafting claims and applications accordingly
  • Navigating the pitfalls of patent prosecution, including novelty and obviousness, sufficiency of the patent specification, as well as examiner interviews
  • Enforcing a patent in the U.S., including preparing for discovery, trial and appeal
  • Strategically using post issuance procedures, including grant review procedure (opposition), inter parties review, and supplemental examination
